Miscellaneous

Applicable Law; Venue. Any dispute or claim (“Dispute) relating in any way to these Terms and/or this Website will be construed in accordance with and governed by applicable U.S. federal laws and the laws of the State of Texas, without regard to principles of conflict of laws. Notwithstanding the foregoing, we both agree that you or Dataclay may bring suit in any court having jurisdiction to enjoin infringement or other misuse of intellectual property rights.

Dataclay reserves the right to seek any and all remedies available by law and in equity for your violations of these Terms. If Dataclay takes any legal action against you as a result of your violation of these Terms, Dataclay will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any injunctive or equitable relief granted to Dataclay.

If you are a consumer and you live in a country (other than the U.S.) where Dataclay markets or promotes this Website, local law may require that certain consumer protection laws and procedures of your country of residence apply to some sections of these Terms, including this Applicable Law; Venue section.
